Terms of Service

By downloading or using Migowrites ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a binding agreement between you and Danica Nacionales ("we," "us," or "our").

1. What Migowrites Is

Migowrites is a creative writing tool designed for producing fictional Social Media AU (Alternative Universe) content. Migowrites is intended for creative and fictional storytelling purposes only. Every exported image carries a Migowrites mark: Free exports are labeled "✦ Created with Migowrites · Fictional content" to identify them as creative work, while Creator exports carry a shorter "✦ migowrites" mark. You are responsible for ensuring your content is used in a manner consistent with these Terms.

2. Age and Eligibility

Migowrites is available to users of all ages. If you are under 13, please review these Terms with a parent or guardian before using the App. By using the App, you represent that you have the legal capacity to agree to these Terms, or that a parent or guardian has done so on your behalf.

3. Acceptable Use

You may use Migowrites to create clearly fictional conversations and panels for fan fiction and creative storytelling.

You may not use Migowrites to:

• Create content intended to deceive others into believing fictional conversations are real
• Impersonate any person in a defamatory, harassing, or harmful way
• Create or distribute content that constitutes libel, fraud, harassment, or hate speech
• Create content that violates applicable local or international laws
• Use the App for any commercial purpose without our prior written consent

We reserve the sole right to determine whether a violation has occurred. Violations may result in account suspension or termination without notice.

4. Intellectual Property

Content you create using the App belongs to you. By using the App, you grant us a limited, non-exclusive, royalty-free license to store, display, and process your content solely as necessary to operate and improve the App, including the right to sublicense to third-party service providers for this purpose.

Migowrites's name, logo, UI, brand, and underlying code are owned by Danica Nacionales and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without prior written permission.

5. Plans, Subscriptions, and Billing

Migowrites is free to download and includes a Free plan with limited projects, panels, and panel types. A paid Creator plan unlocks unlimited projects and panels, all panel types, cloud sync and backup across your devices, bulk export, and a shorter export mark. Creator is offered as:

• Creator Monthly — an auto-renewable subscription billed every month
• Creator Annual — an auto-renewable subscription billed every 12 months
• Creator Lifetime — a one-time purchase that does not renew and is not billed again

a) Price and payment. Current prices, billing periods, and any introductory or promotional offers are shown in the App before you confirm a purchase, in the currency of your App Store storefront. All purchases are processed by Apple. Payment is charged to your Apple Account at confirmation of purchase. We do not receive or store your payment card details.

b) Auto-renewal. Creator Monthly and Creator Annual renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the then-current price for the plan you selected.

c) Managing and cancelling. You can manage or cancel your subscription at any time in your Apple Account settings on your device (Settings → your name → Subscriptions), or at apps.apple.com/account/subscriptions. Cancelling stops future renewals; your Creator access continues until the end of the period you have already paid for. Deleting the App does not cancel a subscription.

d) Price changes. We may change subscription prices. Where a change affects an existing subscription, Apple will notify you and, where required, ask for your consent before the new price takes effect. If you do not agree, you can cancel before the next renewal date.

e) Refunds.Purchases are handled by Apple, so refunds are governed by Apple's policies and are requested from Apple at reportaproblem.apple.com. We cannot issue refunds directly. Except where required by law, payments are non-refundable and there are no partial refunds for an unused portion of a billing period.

f) Changes to plans.We may change the features included in the Free or Creator plans. For material reductions to features included in an active paid plan, we will give at least 30 days' notice by email or in-app notice, and you may cancel before your next renewal.

6. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of defects, and we do not guarantee uptime. You are responsible for keeping your own copies of work that matters to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Danica Nacionales shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. In no event shall our total liability to you exceed SGD $10 or the total amount paid by you for the App in the twelve months preceding the claim, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless Danica Nacionales from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) content you create or distribute using the App; or (c) your violation of these Terms or any applicable law.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms or for operational reasons. Upon termination, your right to use the App ceases immediately. Sections 4, 7, 8, and 10 survive termination.

10. Third-Party Services

The App uses third-party services to operate, including Apple (App Store distribution and payment processing), RevenueCat (subscription and entitlement management), Supabase (authentication and cloud storage), and Cloudflare R2 (image storage). These services have their own terms and privacy policies, and we are not responsible for their practices. Our Privacy Policy describes what each of them receives.

11. Governing Law

These Terms are governed by the laws of Singapore. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you via email or in-app notice at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes your acceptance of the revised Terms.
