Terms of Service

By downloading or using Migo ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a binding agreement between you and Danica Nacionales ("we," "us," or "our").

1. What Migo Is

Migo is a creative writing tool designed for producing fictional Social Media AU (Alternative Universe) content. Migo is intended for creative and fictional storytelling purposes only. Every exported image includes a "✦ migo · fiction" indicator to identify it as a creative work. You are responsible for ensuring your content is used in a manner consistent with these Terms.

2. Beta / TestFlight

Migo is currently available as a beta version through Apple TestFlight. As a beta product, the App may contain bugs, experience downtime, or undergo significant changes without notice. User data may be reset during the beta period. The App is provided without uptime or data preservation guarantees during this phase.

3. Age and Eligibility

Migo is available to users of all ages. If you are under 13, please review these Terms with a parent or guardian before using the App. By using the App, you represent that you have the legal capacity to agree to these Terms, or that a parent or guardian has done so on your behalf.

4. Acceptable Use

You may use Migo to create clearly fictional conversations and panels for fan fiction and creative storytelling. Content featuring public figures is permitted where it is clearly framed as fiction and not intended to be mistaken for real statements or events.

You may not use Migo to:

• Create content intended to deceive others into believing fictional conversations are real
• Impersonate any person in a defamatory, harassing, or harmful way
• Create or distribute content that constitutes libel, fraud, harassment, or hate speech
• Create content that violates applicable local or international laws
• Use the App for any commercial purpose without our prior written consent

We reserve the sole right to determine whether a violation has occurred. Violations may result in account suspension or termination without notice.

5. Intellectual Property

Content you create using the App belongs to you. By using the App, you grant us a limited, non-exclusive, royalty-free license to store, display, and process your content solely as necessary to operate and improve the App, including the right to sublicense to third-party service providers for this purpose.

Migo's name, logo, UI, brand, and underlying code are owned by Danica Nacionales and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without prior written permission.

6. Free Access During Beta

During the beta period, the App is provided free of charge. Features, limits, and access may change with at least 30 days' notice before any paid tier is introduced.

7. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantees of uptime, data preservation, or uninterrupted access.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Danica Nacionales shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. In no event shall our total liability to you exceed SGD $10 or the total amount paid by you for the App in the twelve months preceding the claim, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Danica Nacionales from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) content you create or distribute using the App; or (c) your violation of these Terms or any applicable law.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms or for operational reasons. Upon termination, your right to use the App ceases immediately. Sections 5, 8, 9, and 11 survive termination.

11. Third-Party Services

The App may use third-party services to operate. These services have their own terms and privacy policies, and we are not responsible for their practices. We will update our Privacy Policy when third-party services that process your data are introduced.

12. Governing Law

These Terms are governed by the laws of Singapore. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you via email or in-app notice at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes your acceptance of the revised Terms.
